You are deemed to have accepted and agreed to the terms of this Agreement by using or accessing Finpro Nations (defined below), completing a smart contract on Finpro Nations, and/or clicking "I Accept" on the screen where this Agreement is displayed (the "Acceptance"). You must immediately stop using, accessing, connecting to, or registering to access alien planets if you disagree with these conditions. IF YOU ARE ACCEPTING THIS AGREEMENT ON BEHALF OF A COMPANY OR OTHER LEGAL ENTITY, YOU REPRESENT AND WARRANT THAT YOU HAVE FULL AUTHORITY TO BIND SUCH COMPANY OR OTHER LEGAL ENTITY (AND ITS EMPLOYEES) TO THIS AGREEMENT. You ("us" or "WE") enter into this agreement on behalf of yourself and any other person, business, or other legal entity on whose behalf you are accepting it ("END USER" or "YOU"). THESE TERMS OF USE ALSO CONTAIN OUR COOKIES AND PRIVACY NOTICE, WHICH SHOULD BE READ ALSO IN CONJUNCTION.
This Agreement will be binding upon and apply to the End User after they have accepted it. It is a crucial aspect of the agreement between the parties and will govern their rights and obligations in relation to the contract's subject matter. No particular conditions and no extra terms and conditions of the End User, any of its affiliates, or any third party shall prevail over this Agreement, unless expressly agreed to in writing by us.
No party's involvement in the writing or preparation of this Agreement shall be taken into account when interpreting it. Except as otherwise required by applicable law and in line with this Agreement, A statute or statutory provision, whether referred to before or after the date of this Agreement, includes the statute or provision in question as well as any statute or statutory provision that consolidates, re-enacts, changes, or replaces it. Words with one gender also have the opposite gender in the singular and plural.
In general, personal information you submit to us is used either to respond to requests that you make, aid us in serving you better, or market our Services. We use your personal information in the following ways:
The right to market Finpro Nations or any of its components is not included in the license because it is only meant for noncommercial, personal use. While utilizing the game, website, materials, or services provided by Finpro Nations, you are not permitted to work for pay from sources other than Finpro Nations. Despite the foregoing, you are still allowed to record and stream video content of your own gameplay, as well as distribute it in other ways, on live streaming services and/or video sharing websites, provided that you always abide by the terms and conditions and other requirements imposed on you by such platforms. Any video content must also (a) follow the rules for posting and uploading pictures, (b) be open to all users, and (c) be of a high standard. (c) a disclaimer stating that us or any other organization connected to Finpro Nations does not share the opinions and ideas you express in the video content. If we determine, in its sole discretion, that any such video content is, or may be, unsuitable or otherwise harmful to the operation or commercialization of Finpro Nations, we reserve the right to revoke this license with relation to any current or potential future content.
By signing this agreement, you agree to quickly remove or edit any such content upon us's request. You acknowledge that us is not liable for any losses you might incur as a result of such removal or alteration, and that is another thing you agree to.
To access or utilize Finpro Nations and any of the Website, Materials, and Services, you must first create a Finpro Nations user account (a "User Account"). You affirm and warrant that us has accurate information about you in its hands by creating a User Account. Additionally, you attest that you are older than 18 and acknowledge that you are aware that the Game may be rated as 18 years and older in some locations. You are not permitted to share your registration information or any permissions you might have in your user account with anyone else or with any organization. For the avoidance of doubt, you acknowledge that you will not be the owner of your User Account.
For your User Account and, if necessary, any other identifiers linked to your usage of Finpro Nations, the Website, Materials, and Services, you will be required to choose a username (any such usernames or identifiers "Usernames"). Other users of Finpro Nations, the website, materials, and services, where appropriate, may be able to see user names. You acknowledge that the posting policy must be adhered to by any username you choose or otherwise use.
You are responsible for maintaining the security of your User Account password and login information. You are not permitted to grant anyone else access to your User Account without first obtaining us's express permission. Your login credentials and any associated expenses are solely your responsibility. You must notify us right once if you know or have reason to suspect that someone else has accessed your User Account, login credentials, or password.
Despite the foregoing, the gameplay of Finpro Nations enables players to acquire a limited number of in-game virtual assets that us may occasionally create and disperse in the form of non-fungible tokens issued on the Blockchain or other kinds of Blockchain based tokens, as well as the underlying smart contracts ("NFTs"). NFTs can be created in Finpro Nations as digital collectibles or as gaming aids, but they are not required to.
NFTs may be earned in Finpro Nations in accordance with the smart contract functionality, as decided from time to time at us's sole discretion. We’re also not compelled to sell NFTs or to distribute them in any other way; rather, it is free to do so whenever, however, and on whatever terms it sees fit. This includes, but is not limited to, granting free NFTs to both other users and users of Finpro Nations, the website, products, and/or services.
To purchase NFTs, you must have both an active compliant digital wallet and an active User Account . us has the right to refuse to sell, stop providing, or restrict your ability to buy NFTs in its sole discretion. NFTs may only be purchased in accordance with the particular additional terms and limits that we may occasionally impose in its sole discretion, at the given purchase price, through the defined channels, and in accordance with the aforementioned conditions.
NFTs should only be exchanged among employees or when playing in Finpro Nations. us reserves the right to develop a special transfer policy to control the transfer of NFTs (the "NFT Transfer Policy''). The Website shall make available any applicable NFT Transfer Policy, as it may be revised from time to time.
Every transaction you conduct on the platform will be visible to the public and associated with your address, as you are aware and agree. You agree and realize that you will be solely responsible for all fees, costs, surcharges, or expenditures related to your transactions on the platform.
If you use the links, references, and other elements of Finpro Nations, you might be able to visit other third-party websites or services ("Third Party Services"). These websites or services are not managed or owned by us. All of these references, links, and other features are provided merely for your convenience and information. They do not imply us's endorsement of the products, services, or opinions of any of the aforementioned parties. When the gameplay of Finpro Nations requires the use of a certain Third Party Service, such as for the custody of virtual assets or objects, us does not support or demand its use.
Before engaging in any transactions involving third-party services, you are solely responsible for: I thoroughly educating yourself about the benefits and risks of doing so; (ii) selecting the third-party services you might want to use; (iii) conducting business with third-party service providers; (iv) utilizing third-party services; and (v) protecting your privacy and data in connection with third-party services.
This Agreement shall be effective from the date hereof for a period of thirty (30) calendar days. Until either Party terminates it no later than 15 days before to the end of the applicable period, this Agreement will be in effect after its original term for consecutive terms of 30 calendar days each.
This Agreement (and, thus, your right to access Finpro Nations as permitted) will terminate immediately if an incremental charge is not paid within the allotted 10-day period.
To utilize Finpro Nations, you must provide us with a valid email address ("Notification Address") when you create your user account. You consent to us emailing the Notification Address in plain text any and all notices required by this Agreement, including any bills. When one of these notifications is delivered to the notification address by us, it is considered to have been received. For the duration of this Agreement, you undertake to keep the same Notification Address or promptly let us know in writing if it changes.
